Being Terminated Wrongly
Every country, every state has its rules that govern everyone, both employer and employee. However, the common belief is that employers are not allowed to terminate someone based on their race, religion, sex, national origin, age or disability. It is a truth that is not the truth, as some choose to uphold it while others ignore it.
Employers cannot terminate someone with regards to righting wrong doings, like whistle blowers or because of retaliation. If the employee knows that what he is doing is breaking company rules and refuses to do orders, then the employer may not fire him as per their whim. This is the rule that states an employee can be protected from indiscriminate termination by an abusive employer.
An employee is protected from unlawful termination if the employer engages in so-called discrimination. Discrimination in itself, already warrants criminal behavior and if actions are made based upon the influence of discrimination; the law will deal with it. In example, if a homosexual is slandered, harassed and driven out of his post, he or she can deliver a complaint stating the abuse as well as a plea for reinstatement.
The employee can look at the company hand book to search for rules and regulation as well as their rights. Join a union, file for compensation, whistle blowing – things like these are some that should be upheld as part of a healthy employee’s duties.
Almost a lot of the companies in the US have the employment at will approach. It means that employees can be fired or let go at almost any time for no reason or for a reason. But it also means that the employee can go up and at it and terminate his own contract to leave for somewhere else. Contracts are bound by laws and may prevent employees or employers from letting go of the other within the first few months, but if one party feels that the other has violated the law by termination, then the help of an attorney is always recommended.
